FAQ: What if the Surrogate Wants to Keep the Baby?

This is not a situation we would ever expect to happen, but regardless, there are legal protections built into every surrogacy contract.

The contract will detail the arrangement made by all parties and it will offer protections to both intended parents and surrogates.

At Heartland Surrogacy, we also speak extensively with all surrogate applicants about what it means to be a surrogate and explain how the process works to ensure that they are making an informed decision.

The vast majority of surrogacy journeys in the United States are gestational surrogacy arrangements where there is no genetic connection between the surrogate and the baby(ies) she carries. Many carriers describe their feelings for the baby(ies) they’re carrying as the same they would feel toward a niece or nephew; a bit like family, but not their own child.

Additionally, surrogates are advised to begin a surrogacy journey only once they feel their family is complete. Any pregnancy can pose a risk to fertility, so she may be unable to add to her family after her journey. As a result, surrogates begin a journey already not wanting more children.
